White House tries to avert Senate defeat on border emergency

Four Republican senators said they plan to vote to buck Trump's emergency declaration and others are privately mulling their decision, but Politico reported Republicans are seeking Trump's support for the Article One Act in exchange for voting against the disapproval vote on the border declaration.

The votes - first a resolution passed Wednesday that pulls back American aid to Saudi forces in Yemen, followed by a resolution Thursday to block Trump's emergency declaration on the southern border - have left some in the GOP conflicted about whether they will vote with Trump or protect congressional authority on some of the biggest issues facing the Congress: war and government spending.

"Republican Senators are proposing new legislation to allow the President to violate the Constitution just this once in order to give themselves cover", Pelosi, D-Calif., said in a statement. If Trump would commit to signing a bill handcuffing future emergency declarations, some of them might support his border emergency declaration.

The bill is largely symbolic, as Trump has said he'll veto it and Trump's emergency resolution is already tied up in the courts. On Wednesday, Democratic Representative Joaquin Castro of Texas told reporters Pence's offers "are probably worthless" while Lee said "we should know very soon" if Trump will support the bill.

Lee told a reporter for The Hill that he'll vote for the disapproval resolution. The proposal from had been meant to try to limit the number of Republican defections on the national emergency vote Thursday. Senate passage would send it to Trump's desk, forcing him to issue the first veto of his presidency to strike it down.

To win Senate approval, the House resolution needs four Republican votes along with those of all its Democrats. She said the House would never even consider the bill limiting future declarations by a president, including Trump.

An administration official said the White House is skeptical there will be enough votes to head off a Senate defeat and is reluctant to back limits on future declarations unless a victory on the resolution is assured. The bill would also give Congress the power to limit or amend the scope of any emergency declaration, and require the president to report how exactly his emergency powers are being put to use.

Trump made his views known in a phone call with Lee, as the conservative senator lunched with fellow Republicans at the Capitol, according to a person familiar with the call who spoke on the condition of anonymity to describe it. Tillis faces a potentially tough re-election fight next year.

The "Assuring that Robust, Thorough, and Informed Congressional Leadership is Exercised Over National Emergencies Act" would have ended any president's declarations of national emergency after thirty days unless Congress voted to extend them. Still, Congress would be highly unlikely to muster the two-thirds majorities needed to eventually override a veto. That vote could well occur after Congress returns from a recess later this month.

The strongest chance of blocking Trump's border emergency is likely several lawsuits filed by Democratic state attorneys general, environmental groups and others.
