Congressional aides said House Democrats were expected to file a lawsuit when Trump declares a national emergency in order to protect the House's constitutional powers to decide how USA taxpayers' money is appropriated.

That prospect seems unlikely, however, now that Senate Majority Leader Mitch McConnell has said he will support Trump's emergency declaration.

Pelosi stressed Thursday that the USA lawmakers would be prepared to respond appropriately to Trump's declaration of a national emergency, adding that they could file a legal challenge on the matter.

Late on Wednesday, negotiators put the finishing touches on the legislation that would provide more than $300 billion to fund the Department of Homeland Security and a range of other federal agencies through September 30, the end of the current fiscal year.

The Trump administration will avoid the financial turmoil of about 800,000 federal workers working without pay or going on unpaid leave because of another partial government shutdown.

It will be taken up by the Democratic-controlled House of Representatives and the Republican-led Senate before going to Trump. The bill, which still needs to pass both legislative chambers, provides $1.383 billion for barriers at the US border with Mexico. The bill does not provide money for President Donald Trump's border wall, but does contain money for other border security measures. Lindsey Graham, a onetime Trump critic-turned-loyal ally, told reporters Trump was "certainly inclined to sign it" and "march toward filling in gaps" by using executive action to divert other budget funds into wall-building.

Many subsequent emergency declarations suspended assets, trade or other transactions with nations ranging from Libya to Panama, though most have lapsed after regime changes in those countries, according to the center. "A Democratic president could do that".

Senator Chuck Schumer said if Trump declares a national emergency to build the wall, he would be committing a "lawless act".

The money, which would be taken from construction projects such as hospitals, family housing, and maintenance, would not be replenished until Congress passes another defense appropriations bill, the aides said.

Responding to the president's announcement that he will declare a national emergency related to the USA southern border, Pelosi maintained that "Democratic presidents can declare emergencies as well".

Trump critics concede that the president has broad authority to declare a national emergency under a 1978 law.

House Speaker Nancy Pelosi said Thursday if the Republican president declared the emergency he would be making an "end run around Congress".

Such a move, bypassing Congress and redirecting funds previously approved by lawmakers for other purposes in order to construct the wall, likely would spark a court battle, as it is Congress and not the president that mainly decides how federal funds get spent under the U.S. Constitution. The statement from the two Democratic leaders said that "Congress will defend our constitutional authorities" in the event of a national emergency. Senate Armed Services chairman Jim Inhofe of Oklahoma said he warned Trump not to touch military construction funds, but he could live with using Army Corps funds.

The bipartisan compromise federal spending legislation was passed overwhelmingly by the US Senate. "Most importantly, it will keep our government open".

That's why you see the president trying to declare a national emergency to try to at least give a little bit to Ann Coulter and the people that she represents.

And if it gets to President Donald Trump's desk, there's no guarantee he'll sign it.
