USA levels 23 charges against Huawei for stealing secrets, evading sanctions

The company is also charged in a separate case with stealing trade secrets from T-Mobile, according to federal prosecutors.

An indictment partially unsealed by the Justice Department accused Meng, Huawei, its affiliate in Iran, and a subsidiary in the United States of a long-running scheme to help banks evade U.S. sanctions on Iran.

Meng has said that she is innocent and Huawei did not respond to requests for comment on the charges announced Monday.

"The charges unsealed today clearly allege that Huawei intentionally conspired to steal the intellectual property of an American company in an attempt to undermine the free and fair global marketplace". Ltd., to bypass sanctions placed against Iran.

Due to alleged "misrepresentations by Huawei", the Department of Justice claims that USA banks maintained banking relationships with Huawei, and that these banks could have suffered criminal and civil penalties for processing transactions that were in violation of U.S. regulations and law.

The sweeping indictments accuse the company of using extreme efforts to steal trade secrets from American businesses - including trying to take a piece of a robot from a T-Mobile lab.

In the NY indictment, prosecutors noted that Huawei used its affiliate, Skycom Tech Co.

The Justice Department has charged the defendants with obstruction of justice, violating sanctions, conspiracy to defraud the U.S., and money laundering. Further, as part of an investigation in the Eastern District of New York, Huawei and its US subsidiary are charged with conspiracy to obstruct justice.

The Department of Justice also announced 10 additional charges of wire fraud, trade theft and obstruction of justice against two other Huawei executives who it alleged tried to steal trade secrets. Huawei and Huawei USA are charged with conspiracy to obstruct justice related to the grand jury investigation in the Eastern District of NY.

The U.S.is asking that the Canadian authorities extradite Meng. In one instance, Huawei USA allegedly sent an email to its employees acknowledging that its actions would be illegal in the United States.

Ross noted that the administration had punished another Chinese telecommunications company, ZTE, past year for violating U.S. sanctions.

Matthew Whitaker, the acting attorney general, said grand juries in Seattle and NY had indicted Huawei, its affiliates and its chief financial officer on 23 criminal charges.

"For years, Chinese firms have broken our export laws and undermined sanctions, often using the United States financial system to facilitate their illegal activities", Wilbur Ross, the commerce secretary, said.
