Rod Rosenstein to step down once attorney general is confirmed

Rosenstein has had oversight of the U.S. Special Counsel's probe into alleged Russian interference in the 2016 presidential election and possible connections to Trump's campaign.

Graham said there was "absolutely no indication he was going to tell Bob Mueller what to do, or how to do it".

Mueller and Barr worked together in the early 1990s when Barr was Attorney General under President George H.W. Bush and Mueller was the head of the DOJ's Criminal Division. Graham said he asked Barr.

According to Fox News and ABC News, Mr Rosenstein had long planned to leave after two years as deputy attorney general. 'And do you see any reason for Mr. Mueller's investigation to be stopped?' He said no. Mueller is expected to finish his work by mid-to-late February.

Barr responded, Graham said, that he would "go through the process of what I can share with the Congress and the public, erring on the side of transparency".

After the report broke, Trump promised to get rid of a "lingering stench" at the Justice Department, but weeks later stated that he had a "very good relationship" with Rosenstein, and had "no plans" to give the Deputy AG his marching orders.

But the assurances may not be enough for Democrats, since Graham also said he shared concerns raised by Barr about the possibility of a "slippery slope" from potentially alleging obstruction of justice against a president for firing a political appointee.

The U.S. leader later explained that he retweeted the image because he believed Rosenstein "belongs behind bars" over his decision to pick Mueller to take over the Russian Federation probe, which Trump has repeatedly blasted as a "witch hunt", in May 2017, shortly after the president fired former FBI Director James Comey.

Barr also wrote then that Mueller should not be permitted to "demand" in-person question of the president.

Graham said Barr told him that he has a high opinion of Rod Rosenstein, the current deputy attorney general who has so far overseen the Mueller investigation and is expected to leave office if Barr is confirmed.

In September the New York Times reported, citing anonymous sources, that Mr Rosenstein had discussed recruiting cabinet members to invoke the 25th amendment of the USA constitution, which provides for the removal of a president if he is deemed unfit for office.

Barr was also scheduled to meet with Sens.

Barr's dance card included incoming Chairman Lindsey Graham, R-S.C.; outgoing Chairman Chuck Grassley, R-Iowa; and Nebraska Republican Sen. John Cornyn of Texas and Ben Sasse of Nebraska.
