DHS: Immigrants seeking asylum in U.S. will be sent to Mexico

  • US to send migrants back to Mexico while asylum claims are processed

Rep. Luis Gutierrez (D-IL) bashed Christians who support border security Thursday and said President Trump would have allowed King Herod to murder baby Jesus because of his immigration policy.

Homeland Security Secretary Kirstjen Nielsen announced Thursday any caravan migrants who seek asylum in the United States must wait indefinitely in Mexico until their immigration proceedings at the U.S. Port of Entry are complete.

The government of Mexican President Andres Manuel Lopez Obrador, who took office December 1, said foreigners will have temporary permission to remain in Mexico on humanitarian grounds after getting a notice to appear in US immigration court and they will be allowed to seek work authorization.

The New York Times covers this story "U.S". Mexican government says it reaffirms its sovereign right to admit or reject the entry of foreigners into its territory.

There is no signed agreement allowing third-country migrants to stay in Mexico while their asylum applications are processed in the United States, Mexico's new foreign minister said Friday.

Speaking before lawmakers on Thursday, Nielsen also emphasized that DHS can not detain families with children for more than a few weeks under USA law, which is not enough time for an asylum claim to be processed.

USA border authorities fielded 92,959 "credible fear" claims - the initial step toward asylum - in the fiscal year that ended September 30, up 67 percent from 55,584 the previous year.

While the Central American migrants wait indefinitely, Nielsen said that Mexico has agreed to provide humanitarian visas and work support.

Addressing charges that she has not been "compassionate", Nielsen said: "What we have done is we've worked extensively with the northern triangle countries to find ways to help vulnerable populations as soon in their journey as possible".

"Today, we are announcing historic measures to bring the illegal immigration crisis under control", Nielsen said. For example, asylum officers from Citizenship and Immigration Services do the initial screening, something called a credible fear claim. Release is the process in which asylum seekers are released into the US with an ankle monitor until a later court hearing.

Kilmeade said Nielsen "couldn't have been more impressive" in not losing her cool against an angry Gutierrez, and that the lawmaker was out of line to make "personal insults and rantings".

In late November, Lee Gelernt, an attorney with the American Civil Liberties Union, said there were questions about the legality of such a proposal.

They could, though, through an administrative change, be authorized to approve affirmative asylum claims if they believe those cases are strong enough and they have enough evidence.

In a statement to reporters, Amnesty International executive director Margaret Huang said Mexico is not a safe country for all people seeking protection. "If Mexico could protect them, they would be protecting their own citizens, and they can't".

Last month, Trump invoked national security powers to deny asylum to anyone caught crossing illegally, but a judge halted that change as a lawsuit progresses.

Thousands of migrants have come up from Central America in recent weeks as part of caravans.

"It is repugnant to me and astonishing to me that during Christmas, a time in which we celebrate the birth of Jesus Christ - a Jesus Christ who had to flee for his life with Mary and Joseph", Mr. Gutiérrez said.
