It was ruled that the Northern Ireland Human Rights Commission did not have the power to bring a case, due to the law's rights not being infringed with.

The devolved Northern Ireland Assembly voted in February 2016 against legalising abortion in cases of fatal foetal abnormality, rape or incest.

"As such, the court does not have jurisdiction to make a declaration of incompatibility (with human rights law) in this case", the court said in a summary of the decision.

The commission previous year argued that the current law criminalises "exceptionally vulnerable" women and girls and subjects them to "inhuman and degrading" treatment.

"In the absence of it, then clearly the UK Parliament has responsibility to adhere to human rights standards, and there is a Supreme Court decision coming on Thursday". One group of activists drove around Northern Ireland distributing abortion pills.

Unlike in mainland Britain, abortion is illegal in Northern Ireland, carrying a potential life sentence, except when a woman's life is at risk or there is a permanent or serious danger to her mental or physical health.

But three of Northern Ireland's most senior judges overturned that decision in June previous year, saying it was a question for the elected assembly, not the courts. The prime minister must commit to reforming abortion law immediately or be complicit in the harm and inequality caused by the existing law.

The debate on Northern Ireland's restrictions on abortion has intensified after citizens in the Irish Republic voted by a landslide last month to liberalise the state's laws.

"Nine-point-two million people have had their lives terminated through abortion in Britain since 1967", he said.

An emergency debate on the issue of abortion in Northern Ireland was held in the House of Commons on Tuesday. They want MPs to attend the debate and stress that the democratic process in Northern Ireland be respected.

Sinn Fein vice president Michelle O'Neill welcomed the Westminster debate, describing it as a "first step" on the road to abortion reform in Northern Ireland. Amnesty is calling for the repeal of sections 58 and 59 of the Offences Against the Person Act 1861, which would decriminalise abortion and enable a Human Right compliant healthcare framework to be put in place.
