Texas Sues to End 'Dreamers' Program Once And For All

Texas and six other states filed a federal law suit challenging the constitutionality of the Obama-era Deferred Action for Childhood Arrivals program, reports Politico. President Donald Trump attempted to rescind the program.
But a recent ruling in favor of DACA seems to have shifted up Paxton's timeline. That was the third - and by far the strongest - rebuke of Trump's efforts to rescind the program. Federal judges in California and NY previously handed down similar decisions.
"The Obama Administration pushed through DACA to fit their political narrative and this lawsuit seeks to undo that unlawful action", said General Landry.
"DACA purported to grant lawful presence and work permits to almost one million unlawfully present aliens without congressional approval", stated Paxton.
"Unelected federal judges are forcing the Trump administration to leave an unlawful program like DACA in place indefinitely", Mr. Paxton said.

Whatever the policy implications of these lawsuits, they create uncertainty for the people whose lives are directly affected by them, and because they will drag on for months-if not years-they become ongoing political fodder for politicians like Paxton.
Ending the program would cost Texas more than 100,000 workers and almost billions of dollars in GDP losses, MALC said in a press release.
Tuesday's move leaves plenty of questions going forward - including whether the Justice Department will defend DACA in court in Texas or allow another entity to argue in its favor. "Left intact, DACA sets a unsafe precedent by giving the executive branch sweeping authority to ignore the laws enacted by Congress and change our nation's immigration laws to suit a president's own preferences".
"President Trump has a duty under the Constitution to take care that the law be faithfully executed", Paxton said. This goal of this pursuit has never been to steer immigration policy, but to rightfully return policymaking to the legislative branch of government'. U.S. District Judge Andrew Hanen blocked Obama's plan to defer deportation for 4 million undocumented immigrants in a program called DAPA, or Deferred Action for Parents of Americans. Paxton issued an ultimatum to Trump: End DACA himself or defend it in court and face the prospect it is overturned by a judge that had already rejected the program's expansion in that other lawsuit.
The lawsuit leaves Ayotitla and 3,400 other dreamers in the state uncertain about their futures, "That has created a lot of fear a lot of confusion a lot of danger for dreamers like myself". In court documents filed Tuesday, Paxton and his fellow prosecutors argue that the safety net for children brought to America without proper paperwork was implemented illegally by President Obama in 2012, and should therefore be overturned immediately.
